Gouvernance et développement durable : Le cas de la responsabilité élargie du producteur dans une filière de gestion des déchets

Abstract

La gestion des déchets des équipements électriques et électroniques (DEEE) constitue un enjeu important en matière de développement durable et de responsabilité sociétale des producteurs. S'ils ne sont pas traités correctement, les DEEE peuvent être la source d'une pollution très toxique. Dans ce contexte, la réglementation (directive européenne) met l'accent sur la responsabilité « élargie » des producteurs. Les producteurs sont responsables de la collecte et du traitement de leurs produits en fin de vie. Face à des volumes diffus et mélangés, les producteurs se sont regroupés pour mettre en place des organisations à qui ils ont délégué cette responsabilité : les éco-organismes. Mais ce n'est pas tant la responsabilité de chaque entreprise qui est en jeu que la responsabilité globale de toutes les parties prenantes dans la filière. La gouvernance doit impliquer tous les acteurs susceptibles d'affecter ou d'être affectés par les décisions. La recherche des mécanismes et des lieux d'exercice de la gouvernance appliqués à cette filière nous a conduits à privilégier deux niveaux d'unité d'analyse : les éco-organismes en tant qu'organisation et sur lesquels repose la responsabilité élargie, et la filière en tant que réseau inter-organisationnel. Nous montrons que la gouvernance est mixte dans la filière DEEE. En effet, d'une part les éco-organismes peuvent être considérés comme l'outil de gouvernance opérationnelle de la filière alors que d'autre part la gouvernance stratégique reste du ressort de l'ensemble des parties prenantes de la filière, notamment l'Etat, les associations de consommateurs et environnementales et les collectivités locales. Cette recherche révèle également que le processus d'intégration des parties prenantes dans la gouvernance stratégique a lieu notamment dans des espaces d'échanges informels où s'élabore la rédaction du cahier des charges. Ce dernier étant la base de la réglementation, il doit être mis en oeuvre par les éco-organismes. Pourtant, les acteurs de la société civile, parce qu'ils ont peu de moyens, sont en partie exclus de la procédure d'élaboration du cahier des charges, point-clé de la gouvernance stratégique.
