Abstract

[fre] Faut-il interdire la discrimination dans les marchés publics ?. . Les politiques préférentielles d'attribution des marchés de l'État sont des pra­tiques courantes que les accords commerciaux internationaux cherchent à éliminer. Cet article considère le problème de la discrimination d'un point de vue normatif du point de vue d'un acheteur public préférant les profits nationaux aux profits étrangers et faisant face à des fournisseurs a priori différents. Il apparaît alors que la non-discrimination n'est la politique optimale que dans des situations particulières. L'article met par ailleurs en évidence la complexité des règles concrètes qui pourraient mettre en œuvre cette politique et démontre que le sens de la politique discriminatoire n'est pas remis en cause par la prise en compte de la possibilité de réduction du coût par un effort non observable. [eng] Should discrimination in public procurement be forbidden ?. . Discriminatory policies in public procurement are widespread practices. This paper considers the optimal procurement policy with asymmetric suppliers and costly public funds when the government prefers national profits. We prove that the concrete rule implementing the optimal mechanism is discriminatory and that taking moral hazard into account does not modify the awarding rule.
