Estudio sobre la propiedad intelectual en el sector farmacéutico colombiano

Abstract

“El capítulo de la protección a la propiedad intelectual en el sector farmacéutico ha sido uno de los más controvertidos en el contexto de la negociación del TLC con E.E.U.U. Se trata de un delicado porque lo que está en juego es cómo lograr un acuerdo que garantice el balance adecuado entre los incentivos para innovar y los intereses de los consumidores. Este estudio, financiado por la CAF, cumple un doble propósito. Por una parte, establece el impacto que ha tenido el régimen de protección de propiedad intelectual que aplica el sector farmacéutico en Colombia sobre el costo y el acceso a los medicamentos. Por otra, ofrece algunas consideraciones claves para evaluar a futuro el impacto que podrían tener modificaciones a ese régimen. El acercamiento al mercado que se hace en el presente estudio permite mostrar que el impacto de la protección a la propiedad intelectual sobre los precios de los medicamentos no ha sido determinantes y que hay otras imperfecciones del mercado sobre las que las autoridades deben fijar su atención de manera más prioritaria, para defender a los consumidores del ejercicio de poder de mercado por parte de la industria farmacéutica. El capítulo 1 presenta una resena de la literatura para este trabajo. El 2 presenta la aproximación metodológica que establece un conjunto de medicamentos claves para las enfermedades de mayor frecuencia en Colombia. El 3 introduce el régimen de protección que aplica al sector. El 4 presenta un análisis detallado de precios. El 5 analiza los patrones de gasto en medicamentos observados en Colombia y las dinámicas de entrada de nuevos principios activos al mercado. El 6 presenta las conclusiones.”
