Economía y fallos constitucionales: la experiencia colombiana desde la vigencia de la Carta Política de 1991 hasta 2003

Abstract

El objeto de este trabajo son los fallos económicos más polémicos de la Corte Constitucional colombiana. Primero, se presenta un marco teórico que tiene como base un modelo del Estado que concibe su actividad como la provisión de bienes públicos y meritorios. Segundo, se ofrece un análisis de fallos seleccionados de la Corte Constitucional en cuatro áreas: la autonomía del banco central; la financiación de vivienda, la flexibilidad laboral y el régimen de pensiones. Por último, se discute cómo y de qué manera las recientes propuestas de reforma judicial pueden contribuir a mejorar (o a empeorar) el impacto económico de los fallos económicos de la Corte Constitucional.
