Abstract

Zusammenfassung Keine gemeinnützige Organisation kommt ohne Personal aus. Dabei gibt es klassische Angestellte wie haupt- und nebenberufliche Mitarbeiter, jedoch auch Ehrenamtliche oder Selbstständige. Diese Formen finden sich auf Leitungs-, Führungs- und operativer Ebene. Auf dieser Systematik fußend gibt es in der Praxis eine Vielzahl möglicher Kombinationen, die nicht nur mit unterschiedlichen Begriffen, sondern jeweils auch mit bestimmten Rechtsfolgen einhergehen. Deshalb gilt es sie zu unterscheiden, was Abgrenzungsfragen aufwirft. Hinzu kommt, dass es im Zuge des Nachfolgeprozesses zu einem Wechsel des bisherigen Status kommen kann, sodass Regelungsbedarf besteht.
