Determining Work Capacity

Abstract

For people experiencing disability the first step in the journey towards meaningful work involves administrative procedures of assessing disability and determining work capacity. These assessments constitute the ‘gateway’ to work for people with impairments and the access to supports and services that make working possible. As such they should not only be procedurally fair (transparent, impartial and reviewable) but evidence-based and accurately capturing the true potential of the applicant seeking employment. In line with the UN’s Convention on the Rights of Persons with Disabilities we review the epidemiological and demographic trends that heighten the need to investigate how work capacity is determined; the aim here is to describe how these administrative procedures can be reformed to withstand human rights scrutiny (using Taiwan as an illustrative example), thereby empowering people with disabilities seeking employment and realizing the social benefits of fully integrating them into the labour force.
