He Said, She Said

Abstract

Another weapon that an angry, fired employee can use against your company is the sexual-harassment claim. Even though the law of sexual harassment is related to employment-discrimination law, how this claim comes about after a firing is a little different. Generally, the employee isn’t going to claim that she was fired because of sexual harassment (although there’s one big exception that we’ll talk about at the end of the chapter). Instead, the claim arises this way: “You fired me, eh? Oh, by the way: I was sexually harassed.”
