Applying artificial intelligence in employment services: the role of law and human rights

Abstract

In recent years, artificial intelligence (AI) technologies are gaining increasing prominence in multiple sectors of society. However, the unregulated insertion and deployment of AI technologies into economy and society due to their multifaceted nature can raise significant human rights concerns. In the employment domain, it is widely claimed that discrimination and diversity bias in human resources recruitment and development processes constitute inherent challenges of AI applications. Hence, in treading a more digitalized pathway, from a human rights perspective it is imperative for AI actors to effectively and timely identify, assess and mitigate existing and potential biases in AI-based systems used in the Human Resources Management context. To this end, law and human rights can and should play a key role in the development and utilization of AI in the employment field towards making AI in employment services work in a rights-respecting way and ensuring that no one is left behind.
