Regulatorische Folgen der Finanzkrisen: Auswirkungen auf die Leasing-Branche

Abstract

Im diesem Beitrag werden zunächst die wichtigsten Reformvorhaben im Zuge der Finanzkrise dargestellt, bevor daran anschließend die Auswirkungen dieser Maßnahmen auf die Leasingbranchen untersucht werden. Mit der Unterstellung einer eingeschränkten Bankenaufsicht erhalten alle Reformen der Bankenregulierung für Leasing-Gesellschaften eine erhöhte Relevanz. Obwohl die umfangreichen Reformmaßnahmen primär auf Banken abzielen, ist die Leasingbranche von den neuen Regelungen ebenfalls betroffen. Leasing-Gesellschaften, die Teil eines Bankkonzerns sind, müssen die neuen Regeln in ihrer Gesamtheit anwenden. Leasingverhältnisse sind damit von den höheren Eigenmittelunterlegungsvorschriften und von den Liquiditätsvorschriften betroffen, darüber hinaus müssen auch die Veränderungen in den MaRisk umgesetzt werden. Herstellernahe und unabhängige Leasing-Gesellschaften müssen nur diejenigen Teile der neuen Regulierung umsetzen, die unter die eingeschränkte Bankenaufsicht fallen, dies sind insbesondere Veränderungen in den MaRisk. Schließlich haben die neuen Regelungen auch Einfluss auf die Refinanzierung der Leasing-Gesellschaften. Die neuen Eigenkapitalanforderungen und Liquiditätsvorschriften werden die Refinanzierungskosten der Banken verändern und sich damit auch auf die Finanzierungskosten von Leasing-Gesellschaften auswirken. Darüber hinaus wird Eigenkapital eine noch knappere Ressource als bislang, mit zunehmendem Eigenkapitalunterlegungssatz wird der Anreiz für die Banken größer, Geschäfte zu tätigen, die mit einem niedrigen Risikogewicht verbunden sind.
