Tarifpartnerschaft – ein altes, aber gefährdetes Bündnis?

Abstract

Vor 100 Jahren, im November 1918, wurde das Stinnes-Legien-Abkommen zwischen verschiedenen Arbeitgeberverbänden und Gewerkschaften abgeschlossen. Es beinhaltete die Tarifautonomie und Kollektivvereinbarungen sowie die Einführung des Achtstundentags und von Betriebsräten. Es scheiterte zwar bald, diente aber als Vorlage für die gesetzliche Regelung der Tarifvertragsbeziehungen nach dem Zweiten Weltkrieg. Mittlerweile hat die Tarifbindung allerdings deutlich abgenommen. Viele Arbeitgeber haben in ihren Verbänden eine Mitgliedschaft ohne Tarifbindung. Gleichzeitig ist der gewerkschaftliche Organisationsgrad der Beschäftigten rückläufig. Angesichts einer zunehmenden Ausbreitung prekärer Beschäftigungsverhältnisse muss offenbar der Staat die Tarifvertragsbeziehungen wieder stärker regulieren – wie beispielsweise durch das Mindestlohngesetz.
