Das missachtete Verfassungsgebot - Wie das Sonderungsverbot nach Art. 7 IV 3 GG unterlaufen wird

Abstract

Die Privatschulfreiheit ist in Deutschland in Art. 7 IV GG verfassungsrechtlich gewährleistet. Allerdings dürfen private Schulen als Ersatz für staatliche Schulen nach Art. nach Art. 7 IV 3 GG nur genehmigt werden, wenn „eine Sonderung der Schüler nach den Besitzverhältnissen der Eltern nicht gefördert wird“. Diese Genehmigungsvoraussetzung ist nach der Rechtsprechung des BVerfG strikt und muss fortlaufend eingehalten werden. In der Gesetzgebung der Länder und der behördlichen Genehmigungs- und Aufsichtspraxis wird den Vorgaben des Sonderungsverbots jedoch weitgehend nicht entsprochen. So kommt es zu einer sozialen Segregation der Schüler an den Privatschulen, die das Verfassungsgebot aushöhlt.
