Reformoptionen zur Wettbewerbspolitik in Österreich

Abstract

Das aktuelle Kartellrechtsregime ist in Österreich seit sechs Jahren in Kraft. Aus den Erfahrungen zeichnen sich deutlich Stärken und Schwächen der gewählten Organisationsstruktur und des Verfahrens ab, aus denen ein Reformbedarf abgeleitet werden kann. Er ist wesentlich dadurch bedingt, dass die Kartellrechtsreform 2002 soweit wie möglich an das alte zivilgerichtlich organisierte System anzuknüpfen versuchte. Mit der Etablierung der Bundeswettbewerbsbehörde wurde ein zivilgerichtlich-verwaltungsbehördliches Mischsystem geschaffen, indem eine Verwaltungsbehörde als "Fremdkörper" in ein Gerichtssystem eingepflanzt wurde. Aus den grundsätzlichen Inkompatibilitäten zwischen gerichtlichen und verwaltungsbehördlichen Zuständigkeiten und Verfahrensweisen ergeben sich Reibungsverluste, welche die Effizienz der Ablauforganisation kartellrechtlicher Verfahren beeinträchtigen. Die Optimierungsmöglichkeiten innerhalb des bestehenden Systems sind beträchtlich, viele davon erfordern nur relativ einfache Änderungen.
