Abstract

[eng] Economics and the law : from the economic approach to law to new meetings ?. . In the article, relationships between Law and Economics are classified into three categories. The first is the Economics Approach to Law stream which is particularly implemented by the Chicago School. The legal rules are considered as a object for microeconomic analysis which emphazises their efficiency properties. The second category includes analysis showing various interactions between legal and economic normativies. notably in the field of antitrust policies. The last category is the most recent and original among the three. It relates to the integration of legal rules into the field of organizational analysis. The author intends to show that the shift of the level of analysis of the legal rules, from the market place to the internal organization, opens new perspectives for the dialogue between Law and Economics. Les relations entre l'économie et le droit peuvent être analysées sur plusieurs registres, que l'article situe à trois niveaux. Le premier est celui qui est privilégié par le courant de l'analyse économique du droit développé par l'école de Chicago, qui étudie les règles juridiques sous l'angle de certains critères d'efficience. Le deuxième niveau est investi par le droit économique entendu au sens large, et permet de poser en termes synthétiques les interactions entre les normativités juridiques et économiques. Ces interactions sont manifestes dans le domaine du droit de la concurrence. Enfin, le troisième niveau est celui de la place des règles juridiques dans l'économie des organisations, dont l'auteur tente de montrer qu'il est riche en perspectives pour les relations entre l'économie et le droit.
