Abstract

[fre] L'objet de cet article est de montrer l'évolution des brevets pharmaceutiques à travers les stratégies de différents groupes d'acteurs : les pays développés (PD) et les pays en développement (PED). Si les accords ADPIC marquent un nouveau renforcement de l'exclusivité du droit, en discutant l'utilisation des licences obligatoires et des importations parallèles aux PED qui cherchent à améliorer l'accès aux médicaments antisida dans leur pays, les multinationales ont ouvert un débat autour de ce que nous appelons la dimension duale des accords ADPIC, à la fois exclusifs et « inclusifs ». [eng] This article shows pharmaceutical patents evolution though strategies of developing and developed countries. If TRIPS set up a new strengthening of right exclusivity, by disputing the use of compulsory licenses and parallel imports to developing countries in search of the improvement of local access to AIDS drugs, multinationals have opened a debate about what we call the dual dimension of TRIPS Agreements, both exclusive and « inclusive ».
