La valeur de la protection des brevets français appréciée par leurs renouvellements

Abstract

[eng] The Value of French Patent Protection Assessed by Renewals.. In this article, we compute the value of patent protection obtained through application for patents at the French Patent Office (INPI ), using patent renewal data and values of renewal fees payable to maintain patents in force, over the 1951-2000 period. Simulations of patent protection value, based on our econometric estimations for the 1951-1993 period, demonstrate that average patent values increased continuously and substantially during this period and that the patent value distribution function is strongly asymmetric. Interpreting this increase in the average value of patent protection as evidence of improvement in the intrinsic quality of innovations protected by patents, we explain a substantial portion of the decrease in the patents-to-R & D ratio by a focusing of R & D on more highly-valued objectives. [fre] Dans cet article, nous mesurons la valeur de la protection que confère un brevet déposé auprès de l’office de brevets français (INPI) en nous fondant sur les statistiques de renouvellement de brevets ainsi que sur les montants des annuités de renouvellement devant être acquittées pour leur maintien en vigueur, pour la période 1951-2000. Les simulations de la valeur de la protection des brevets que nous effectuons en utilisant les résultats de nos estimations économétriques sur la période 1951-1993 montrent que la valeur moyenne a continûment et largement augmenté sur cette période et que la distribution de la valeur des brevets est fortement asymétrique. En interprétant cette hausse de la valeur moyenne de la protection des brevets comme une manifestation de l’amélioration de la qualité même des innovations protégées, on explique une part non négligeable de la chute du ratio brevets / R & D par une focalisation de la recherche et développement sur des objectifs de plus fortes valeurs.
