Le jugement de la Cour européenne de justice dans l'Affaire Temelín

Abstract

Le 27 octobre 2009, la Cour de justice des communautés européennes (CJCE) a rendu une décision historique dans l’affaire dite CEZ au sujet de l’exploitation de la centrale nucléaire de Temelín en République tchèque. La centrale nucléaire de Temelín a longtemps entaché la relation de voisinage entre l’Autriche et la République tchèque, par implication non seulement des communautés locales, mais aussi d’hommes politiques de haut niveau, de membres du Parlement et des institutions européennes. Pour le monde extérieur, il est en effet difficile d’appréhender le fait que le credo antinucléaire fait partie de l’identité autrichienne. C’est dans le cadre de cette relation tendue que l’affaire, dont le jugement est analysé dans la présente étude, a été portée devant la CJCE.
