Entgeltgleichheit und Begrenzung der Flexibilisierung geringfügiger Beschäftigung durch kollektivrechtliche Regelungen

Abstract

Labour rights of (marginalized) part time workers (which are privleged concerning social security costs), are often violated, especially concerning distribution of working time and pay. Contrary to § 3 (1) EGFZ they regularly don´t get any sickness pay, moreover, part time workers are often discriminated. Although employers solely have to bear social security costs for part time workers, they often shift them to the employees by stipulating net wages in the work contracts. This is not only a violation of compulsive social security norms, but a discrimination of the (most female) part time workers. Also the regulation for work on demand in § 12 Teilzeit- und Befristungsgesetz are often not respected. Especially concerning this theme, works councils and collective bargaining partners are able to set upprotective rules for part time workers. These Possibilities are described in detail.
