Normenwandel und Justizreform - Das Beispiel der Arbeitsgerichtbarkeit

Abstract

Der Normenwandel im Arbeitsrecht manifestiert sich auch in der Ausgestaltung der Arbeitsgerichtsbarkeit. Der besondere Charakter des Arbeitsvertrags war bereits in der Weimarer Republik die Basis für Forderungen nach einer Eigenständigkeit des Arbeitsrechts als Rechtsgebiet. Dieser Anspruch umfasste auch die Forderung, Arbeitsgerichte einzurichten, die weitgehend unabhängig von der Justiz agieren. Zwar wurde das Arbeitsgerichtsgesetz bereits 1926 erlassen, doch erst nach dem Ende des Zweiten Weltkriegs wurden die Einrichtungen tatsächlich unabhängig. Aber der Status der Arbeitsgerichte blieb nie unumstritten. Spätestens seit den 1960er Jahren wurde ihre Unabhängigkeit schrittweise wieder unterspült. Fiskalische Erwägungen sowie die Öffnung der SPD für liberale rechtspolitische Argumente waren dabei die entscheidenden Faktoren.
