Abstract

Il contributo ripercorre criticamente la vicenda di Facebook relativa alla violazione dei dati degli utenti che ha condotto nel 2012 all’approvazione di un primo consent order da parte della FTC, e che – a seguito dello scandalo Cambridge Analytica – ha indotto l’agenzia nord-americana a riaprire le indagini e ad adottare ulteriori misure rimediali. I profili che emergono dalla storia, all’intersezione tra tutela della riservatezza e antitrust, sono inquadrati nell’ambito dell’imponente dibattito sul tema, cercando di rapportare l’elaborazione teorica ai principali ambiti applicativi. Chi ne esce vincitore?
