The Big Data antitrust story: theoretical approaches and the first enforcement cases

Abstract

Il contributo analizza criticamente il dibattito che negli ultimi anni ha riguardato il fenomeno dei Big Data. Sono pertanto passate in rassegna le diverse argomentazioni emerse a livello teorico circa i potenziali benefici e gli effetti negativi che possono determinarsi in virtù dell'aggregazione ed uso di ingenti volumi di dati. Nel valutare le differenti prospettive di inquadramento del fenomeno in chiave antitrust, di tutela del consumatore e della privacy, viene posta enfasi alla prassi decisionale più significativa. In particolare, in relazione al controllo delle concentrazioni, sono ricostruiti i casi "Google/DoubleClick" e "Facebook/WhatsApp" al fine di appurare, a livello applicativo, i profili maggiormente problematici.
