Peer to peer businesses, regulation and competition

Abstract

La tecnologia offre alle imprese "peer to peer" (P2P) la possibilità di creare network decentralizzati di fornitori individuali che competono con le imprese tradizionali. Questi network possono determinare la crescita tanto dei mercati, quanto della partecipazione agli stessi, incrementare l'efficienza economica e sconvolgere le strutture di mercato esistenti e la posizione degli "incumbent". Le imprese P2P mettono a dura prova una regolamentazione pensata per i tradizionali modelli di business. Anziché limitarsi ad estendere la regolamentazione già esistente alle nuove forme di impresa, i regolatori dovrebbero mirare a porre sullo stesso piano i risultati per i consumatori. Ciò potrebbe richiedere dei cambiamenti sostanziali nell'approccio alla regolamentazione. L'economia dell'impresa P2P genera, inoltre, problemi concorrenziali simili a quelli che in genere occorrono sulle piattaforme online. Le autorità deputate alla tutela della concorrenza devono essere consapevoli del fatto che le "proxies" e le tecniche adottate nei mercati tradizionali potrebbero non rivelarsi appropriate nel contesto P2P.
