Abstract

Il contributo esamina, con un approccio casistico, il tema della responsabilità dei gruppi di imprese per violazione delle norme concorrenziali, alla luce della nozione di entità economica unitaria coniata dalla giurisprudenza per fronteggiare i problemi giuridici connessi all'imputabilità alla società controllante delle condotte commerciali della controllata. Confrontando, in un'ottica comparatistica, le soluzioni predisposte nel contesto europeo e nel sistema statunitense, vengono evidenziate le maggiori criticità della tematica, dovute anche all'assenza di riferimenti normativi specifici, e si ipotizza la realizzazione di un modello regolatorio nel segno della convergenza tra ordinamenti giuridici.
