The antitrust fines in the enforcement practice: going to the grief wracked city

Abstract

Il contributo esamina criticamente le modalità attraverso le quali è stato esercitato il potere sanzionatorio da parte della Commissione europea, dal 2007 al 2013; e, per l'Autorità Garante, tra il 2000 e il 2013. Dopo aver ricostruito le finalità dell'impianto sanzionatorio nei due ordinamenti, viene svolta un'analisi quantitativa e qualitativa sui profili più rilevanti: oltre ai valori assoluti delle ammende, è posta enfasi sull'ammontare delle sanzioni irrogate rispetto al fatturato globale delle imprese coinvolte, disarticolando il percorso valutativo al fine di tenere in adeguata considerazione le variazioni normative intercorse durante i periodi di riferimento. Inoltre, vengono suddivise le sanzioni in funzione delle classi di fatturato delle imprese soggette alla misura rimediale ed è dedicata attenzione all' "iter" seguìto dalle due istituzioni per la quantificazione delle ammende, vagliando le caratteristiche delle singole componenti. Infine, sono svolte una serie di considerazioni circa la capacità dell'impianto sanzionatorio di raggiungere gli obiettivi punitivi e di deterrenza. Indicando le maggiori criticità e le prospettive per il relativo superamento.
