Fondi Sovrani e concorrenza sleale nello sport

Abstract

Il saggio si propone di esaminare l’incidenza della partecipazione dei Fondi Sovrani, in particolare quelli provenienti da Stati extra UE, nel settore sportivo, attraverso un’analisi degli aspetti concorrenziali e del quadro normativo di riferimento. L’indagine mira a verificare se le sovvenzioni erogate dai Fondi Sovrani possano configurare una violazione della disciplina sugli aiuti di Stato, come delineato dagli articoli 107 e 108 del TFUE, mettendo in luce le potenziali distorsioni del mercato che tali interventi potrebbero generare. Il lavoro esamina altresì il Regolamento (UE) 2022/2560, introdotto con l’obiettivo di mitigare gli effetti distorsivi delle sovvenzioni estere, e il ruolo della Commissione europea nel monitorare e regolare tali interventi. Infine, vengono esplorati i rimedi previsti dal diritto interno per contrastare la concorrenza sleale derivante da sovvenzioni di matrice sovrana.
