4-Week Billing: A Behavioural Antitrust Analysis

Abstract

Nel gennaio 2020, l’Autorità Garante della Concorrenza e del Mercato ha sanzionato i principali operatori di telefonia mobile e fissa (Fastweb, T im , Vodafone e Wind Tre) per un’intesa restrittiva della concorrenza, in violazione dell’art. 101 del Trattato sul Funzionamento dell’Unione Europea, relativa alla nota vicenda della fatturazione quadrisettimanale (28 giorni). La vicenda nella sua interezza, anche con riferimento alle condotte che si sono svolte precedentemente all’intesa, offre un interessante spunto di riflessione su diversi aspetti. Il primo di questi riguarda certamente l’analisi comportamentale dei consumatori e la loro percezione del prezzo mensile. Il secondo concerne invece la distinzione tra adattamento intelligente e intesa restrittiva in mercati connotati da un elevato grado di concentrazione. Il terzo, infine, interessa gli incentivi alla partecipazione ad un’intesa in un mercato che, almeno apparentemente, è connotato da un elevato grado concorrenza.
