Social and Legal Perspectives on Informed Consent. A Bioethical Approach

Abstract

In the biolaw literature, the concept of valid consent is sought to be accredited instead of informed consent when discussing medical responsibility and doctor's obligation to inform the patient, as part of their professional obligation, to provide them with treatment/care. In this paper we present a few cases related to ECHR and also a current case of possible malpraxis presented to the Romanian Court, not yet solved at this date.
