Kündigungsschutz als Beschäftigungshemmnis? : empirische Evidenz für die Bundesrepublik Deutschland

Abstract

"Spätestens seit Anfang der 80er Jahre ist das in den meisten westeuropäischen Ländern während der 60er und 70er Jahre weiter ausgebaute System des gesetzlichen und kollektivvertraglichen Kündigungsschutzes zunehmend in den Mittelpunkt der 'Flexibilisierungs'- und 'De-Regulierungs'-Debatte gerückt: Rechtliche und kollektivvertragliche Kündigungsbeschränkungen hätten sich unter veränderten gesamtwirtschaftlichen Rahmenbedingungen zu institutionellen 'Rigiditäten' entwickelt, welche eine flexible Anpassung der Beschäftigung an konjunkturelle Auslastungsschwankungen und an die Erfordernisse des wirtschaftlich-technischen Wandels erschwerten bzw. verzögerten und sich damit mittelfristig negativ auf die internationale Wettbewerbsfähigkeit auswirkten. Die Kritik am Kündigungsschutz beruht dabei auf zwei (meist impliziten) Grundannahmen, - erstens, daß rechtlichen und kollektivvertraglichen Kündigungsschutzregelungen in der Tat ein nicht unwesentlicher eigenständiger Einfluß auf das betriebliche Beschäftigerverhalten zukommt. - und zweitens, daß die Erleichterung externer Beschäftigungsanpassungen in Form von Entlassungen und Neueinstellungen nach dem US-amerikanischen Muster des 'Heuerns und Feuerns' von Arbeitskräften die allokative Effizienz des Arbeitsmarktes nachhaltig erhöhen und damit zu einem rascheren Abbau der gegenwärtigen Arbeitsmarktungleichgewichte beitragen könnte. Beide Annahmen werden mit der für die Bundesrepublik Deutschland verfügbaren empirischen Evidenz konfrontiert. Die Ergebnisse rechtfertigen starke Zweifel an der Hoffnung, daß sich durch eine selektive Lockerung bestehender Bestandsschutz-Regelungen das betriebliche Einstellungsverhalten in nennenswertem Maße modifizieren und darüber vermittelt postive Beschäftigungsimpulse bewirken lassen."
