Erfordern globale Unternehmensstrukturen globale Wettbewerbsregeln?

Abstract

Die fortschreitende wirtschaftliche Integration und die vielfältigen Möglichkeiten für globale unternehmerische Aktivitäten erfordern Strategien zu ihrer Umsetzung. Bedarf es globaler Wettbewerbsregeln, um den globalen Wettbewerb zu schützen? Für Ulf Böge, Bundeskartellamt, sollte der Weg zu einer internationalen Wettbewerbspolitik nicht über eine »harte Harmonisierung«, sondern Diskussionen und Kooperationen der nationalen Wettbewerbsbehörden führen. Auch Wolf Schäfer, Helmut-Schmidt-Universität Hamburg, teilt die Auffassung, dass eine Kooperation der Wettbewerbsbehörden einer administrativen Harmonisierung der Wettbewerbsregeln vorzuziehen sei. Henning Klodt, Institut für Weltwirtschaft, Kiel, unterstreicht, dass globale Wettbewerbsregeln nationales Wettbewerbsrecht nicht ersetzen, sondern ergänzen und flankieren sollten. Wolfgang Kerber, Universität Marburg, vertritt die These, dass kein internationales Wettbewerbsrecht notwendig ist, aber dass internationale Verfahrensregeln erforderlich seien. Theresia Theurl, Universität Münster, sieht den Status quo darin, dass globale Wettbewerbsregeln nur in Ansätzen bestehen und die Gründe dafür in den Kosten, die sie verursachen, l iegen. Und Georg Koopmann, HWWA, spricht sich vor allem für eine Internationalisierung der Wettbewerbspolitik aus.
