Sollte an den Übergangsbestimmungen zur Arbeitnehmerfreizügigkeit festgehalten werden?

Abstract

Die Übergangsregelungen zur Arbeitnehmerfreizügigkeit, die im Beitrittsvertrag 2003 vereinbart wurden, erlauben, dass die Einführung von Teilen der Gemeinschaftsbestimmungen zur Freizügigkeit von osteuropäischen Arbeitnehmern in der erweiterten EU von ihren Mitgliedstaaten für eine Höchstdauer von sieben Jahren ausgesetzt werden kann. Dieser Zeitraum ist in drei Phasen unterteilt. Die erste Phase der Übergangsregelungen endet jetzt am 30. April 2006. Norbert Berthold und Michael Neumann, Universität Würzburg, plädieren in ihrem Beitrag für die sofortige Einführung der Freizügigkeit, denn sie wird zu "Wohlfahrtsgewinne für alle" führen. Im Gegensatz dazu argumentiert Gerd Andres, Parlamentarischer Staatssekretär beim Bundesministerium für Arbeit und Soziales, für die Beibehaltung des gesteuerten Zugangs zum deutschen Arbeitsmarkt, da "Übergangsbestimmungen ein wirksames Instrument zur schrittweisen Anpassung bei großem wirtschaftlichem und sozialem Gefälle zwischen unterschiedlichen Staaten sind".
