De la théorie de l’émanation et de sa délicate cohérence en droit français

Abstract

The concept of emanation or alter ego has many applications in both international and French law. In particular, it is used not only in matters of enforcement but also in the context of sovereign immunity from execution. However, the question of whether there is a genuine theory in this respect is a difficult one. Indeed, there is a kind of inconsistency in the way the concept is understood in these two closely related areas of enforcement on the one hand and immunity from execution on the other. The purpose of this article is to shed light on this inconsistency and to assess whether there is now a truly unified theory of emanation in French law.
