Chaînes de valeur mondiales : théorie et dogme des obligations de l’entreprise

The question of whether companies have obligations towards their supply chain is currently the subject of growing debate. The discussion is based on national and European legislative initiatives that want to oblige companies to monitor their supply chain from the perspective of human rights, environmental protection and labor standards. This paper proposes to integrate the social and economic analysis of global value chains into the issue of corporate supply chain obligations. On this basis, it discusses the fundamental function that individual company obligations for ecological and social improvement can play in the global production of goods and the systemicity of these obligations. The article refers by way of example to the duty of care enshrined in the French law of 2017 and the German duty of care law of 2021.
