Le pouvoir normatif des entreprises multinationales en droit international

The analysis presented in this article reveals the adjacent and underlying normative role of transnational corporations due to their statutory non-existence within the international legal order. Their active participation in international institutions through the development of a diplomacy around standards contributes consecutively to the normative action of these corporations from a proactive point of view and from a reactive point of view in international law. The entry of multinational corporations into the international normative process reflects their normative power both in international law and in relation to international law. The elusive legal nature of multinational corporations and the fluctuating normativity of the international normative corpus generate a private instrumentalization of international standards, which leads to the transformation of these economic operators into legal operators, since they contribute to the dissemination of international law.
