Les modes alternatifs de résolution des litiges administratifs en Afrique noire francophone

The topic of ?justice in Africa? has widely inspired Africanist and African doctrine. The dominant position is one of a critique with regard to its reception, conception, structuring, independence, access, and procedures. In short, institutional justice is believed to be in crisis. Other issues are raised with respect to administrative justice specifically. Commentators have lamented in particular the lack of specialization of judges, the timidity of judicial review, complicity with public officials, laxity, poor productivity, mimicry of French case law, and the non-compliance of the public administration with regard to judgments. If it is agreed that institutional administrative justice, as conceived and practiced since independence, has failed to provide effective solutions to disputes between the public administration and citizens in sub-Saharan French-speaking Africa, could we use alternative modes to realize the idea of justice?the ultimate aim of law ? This study reveals a weak inclusion of alternative modes in statutory provisions and case law in the five states that make up the local framework focused on here. It then sets out, adopting a prospective approach, the need to increase the use of alternative modes of resolving administrative disputes, as these modes best match the African cultural conception and socioeconomic challenges.
