Regulierung europäischer Arbeitsbeziehungen: Das Beispiel Europäische Aktiengesellschaft

Abstract

Der Beitrag schließt eine wesentliche Lücke in der vorliegenden Literatur zur Europäischen Aktiengesellschaft (SE), indem die bislang dominierenden, rein juristischen Beschreibungen durch eine industrial relations-Perspektive ergänzt. Nach der Einleitung zu nationalen Unterschieden der Arbeitnehmerbeteiligung wird zunächst zum besseren Verständnis der SE, vor allem der wesentlichen Probleme ihrer Regulierungsmaximen, die aktuellere Entwicklung im Sinne „stilisierter Fakten“ analysiert. Anschließend werden die Richtlinien zu Europäischen Betriebsräten sowie zur SE verglichen, wobei trotz vorhandener Gemeinsamkeiten die offensichtlichen Hauptunterschiede im Mittelpunkt stehen. Weiterhin wird belegt, dass die SE das prototypische Beispiel für einen neuen, gegenwärtig dominierenden Modus „europäischer“ Regulierung darstellt. Der Beitrag schlussfolgert, dass die Zukunftsaussichten europäischer Arbeitsbeziehungen nach wie vor pessimistisch zu beurteilen sind.
