The Relationship of the Structural Rules of the Comprehensive Welfare and Social Security System with the Substantive Rules of this System (in Persian)

Abstract

Comprehensive Welfare and Social Security System Structure Act, ratified in 2004, brings about a structure, composed of principles, policies, components as well as fundaments within which the substantive laws are regulated and enforced. From such a perspective, it holds a pivotal position to study the relationship between the regulations of Comprehensive Welfare and Social Security System Act and the former substantive laws. The present article studies this aspect of Comprehensive Welfare and Social Security System Act regarding the principles and policies of the system. Meanwhile, it is proven that although the verdicts concerned do not contradict with the former substantive laws in a way to consider them as its abrogation or appropriation, its essence is of such a type that could be employed as the exegete of the former or subsequent substantive rules. This research tries to study the role of the principles and policies dominant on the Comprehensive Welfare and Social Security System in the exegesis of the verdicts and substantive regulations.
