Das Bundesverfassungsgericht im System des Europäischen Unionsrechts

Abstract

Das Bundesverfassungsgericht - nicht aller Deutschen liebste Institution - sichert nicht nur als seine Hauptaufgabe die Geltung und Wahrung des Grundgesetzes durch alle staatlichen Organe. Im Zuge der Einbindung Deutschlands in den europäischen Integrationsprozess ist ihm zusätzlich die Rolle eines Wächters und in jüngster Zeit sogar eines Bollwerks gegen fehlerhafte Entwicklungen des europäischen Verfassungsprozesses zugewachsen. Es nimmt dabei mit Gelassenheit in Kauf, dass es mit dem Europäischen Gerichtshof in Konflikt gerät, für den die Unterordnung aller Gerichte der Mitgliedstaaten, einschließlich ihrer Verfassungsgerichtshöfe zu seinem Selbstverständnis zählt. Seine Rolle im System des gerichtlichen Rechtsschutzes der Europäischen Union zählt zu den leidenschaftlich kontrovers diskutierten Themen der Europarechtslehre und Europapolitik.
