Tariftreue und Vergabemindestlohn in Mecklenburg-Vorpommern

Abstract

Mit dem Gesetzentwurf für eine "Modernisierung des Vergaberechtes" möchte die Landesregierung von Mecklenburg-Vorpommern sicherstellen, dass zukünftig nur noch solche Unternehmen öffentliche Aufträge erhalten, die bei der Auftragsdurchführung ihren Beschäftigten mindestens die Löhne und Arbeitsbedingungen garantieren, die in einem Branchentarifvertrag festgeschrieben sind. Mecklenburg-Vorpommern folgt damit einem bundesweiten Trend, wonach immer mehr Bundesländer umfassende Tariftreuevorgaben in ihre Vergabegesetze aufnehmen. Eine grundlegend veränderte Rechtslage in Europa erlaubt dabei, die Beschränkungen früherer Vergabegesetze zu überwinden und für alle öffentlichen Aufträge die Einhaltung von tarifvertraglichen Standards zu verlangen. Damit kann die öffentliche Hand einen wichtigen Beitrag zur Stabilisierung und Stärkung der Tarifbindung in Deutschland leisten. [...]
