Wahlrechte von Banken und Aufsicht bei der Umsetzung von Basel II

Abstract

Die Vereinbarungen des Baseler Ausschusses für Bankenaufsicht über die Eigenkapitalausstattung international tätiger Banken sollen Wettbewerbsgleichheit auf dem internationalen Bankenmarkt schaffen. Der Aufsatz zeigt, dass die Neue Baseler Eigenkapitalvereinbarung durch ihre zahlreichen Wahlrechte für nationale Aufsichtsinstitutionen dieses Ziel gefährdet. Zudem bietet das aufsichtliche Überprüfungsverfahren große diskretionäre Spielräume zur Begünstigung des nationalen Bankensektors. Um eine mögliche Aufweichung der Eigenkapitalvereinbarung zu verhindern, schlagen die Autoren eine intensive Überwachung der nationalen Auslegung von Basel II durch den Baseler Ausschuss vor. Verbesserte Offenlegungsanforderungen könnten ebenfalls die Gefahr verringern, dass der Wettbewerb nationaler Aufsichtsinstitutionen und regulatory capture zu laxer Überwachung und unzureichender Eigenkapitalausstattung von Banken führt.
