Waffenlieferungen an die Ukraine: "Fahren auf Sicht" - auch was das Völkerrecht angeht

Abstract

Deutschland unterstütze die Ukraine durch Waffenlieferungen bei der Ausübung ihres individuellen Rechts auf Selbstverteidigung gegen den von Russland geführten völkerrechtswidrigen Angriffskrieg, werde dadurch aber nicht zur Kriegspartei. So lautet die Position der Bundesregierung. In völkerrechtlicher Hinsicht stellt sich jedoch die Frage, wann das Unterstützen in einem bewaffneten Konflikt in eine indirekte Gewaltanwendung umschlägt. Dann müsste nämlich das kollektive Selbstverteidigungsrecht in Anspruch genommen werden. Und man könnte sich kaum mehr darauf berufen, nicht Konfliktpartei zu sein. Doch das ius contra bellum und das humanitäre Völkerrecht geben keine eindeutigen Antworten darauf, wann die betreffenden Schwellen überschritten sind.
