Bosnien, die USA und die "Algier-Gruppe" von Sarajevo: Antiterroristische Politik im Konflikt mit Menschenrechtserwägungen?

Abstract

Die Zentralregierung Bosnien-Hercegovinas (BiH) hat am 18. Januar 2002 sechs mutmaßliche Terroristen algerischer Abstammung den USA ausgeliefert. Dafür bedankte sich Washington noch am selben Tag, während in BiH spektakuläre Demonstrationen abliefen und massiver Protest gegen das Vorgehen der Regierung laut wurde - ausgelöst vor allem dadurch, daß die Auslieferung gegen einen letztinstanzlichen Entscheid des bosnischen Menschenrechts-Gerichtshofs erfolgt war. Politisch verbuchte die Regierung die bevorstehende Aufnahme in den Europarat, die man seit Jahren vergeblich erstrebt hatte. Die bosnische Öffentlichkeit hielt zum größeren Teil an ihren Vorbehalten gegen den Auslieferungsbeschluß der Regierung fest: Repräsentativumfragen von Ende Januar ergaben 51% Ablehnung, 44% Zustimmung und 5% Unentschiedenheit. Seither wird in BiH über ein Grundproblem diskutiert: Rechtfertigt ein erfolgreich bewältigter »Notstand« die Verletzung des Verfassungsgebots der primären Beachtung von Menschenrechten?
