Schutz der Zivilbevölkerung vor den Wirkungen von Explosivwaffen (EWIPA): Eine Staatenerklärung soll dem Humanitären Völkerrecht Geltung verschaffen

Abstract

Der rücksichtslose Einsatz von Explosivwaffen in Städten hat in vergangenen und gegenwärtigen bewaffneten Konflikten zahlreiche Opfer unter der Zivilbevölkerung gefordert. Eine internationale Erklärung soll helfen, die Gebote des Humanitären Völkerrechts zum Schutz der Zivilbevölkerung durchzusetzen. Dazu sollen die Staaten restriktive Einsatzregeln für die Streitkräfte festlegen. Auch sollen Langzeitfolgen der Zerstörung urbaner Infrastruktur, die oft in humanitäre Katastrophen münden, vermieden werden. Ein völliges Einsatzverbot für Explosivwaffen in Stadtgebieten wäre indes nicht konsensfähig. Es würde die Verteidigung dicht besiedelter Industriestaaten in Frage stellen. Der Regelungsansatz wird auch dadurch erschwert, dass in innerstaatlichen Konflikten nichtstaatliche Akteure kämpfen. Zudem ist gezielten Terrorangriffen auf Zivilisten nicht mit Erklärungen beizukommen. Gleichwohl gilt es, die Zivilbevölkerung in bewaffneten Auseinandersetzungen besser zu schützen.
