Sorgfaltspflichten im Rohstoffhandel: Händler und Börsen als Nadelöhre für Nachhaltigkeit in metallischen Lieferketten

Abstract

Die Bundesregierung hat sich im Eckpunktepapier "Wege zu einer nachhaltigen und resilienten Rohstoffversorgung" das Ziel gesetzt, Standards für die verantwortungsvolle Beschaffung von Metallen zu etablieren. Deutsche Firmen beziehen Metalle oftmals über Händler, Börsen und außerbörsliche Handelsplätze. Diese sind überwiegend außerhalb der Europäischen Union (EU) angesiedelt, und zwar in Ländern, deren Regulierung für die Umsetzung unternehmerischer Sorgfaltspflichten schwächer ist als in der EU. Rohstoffhändler und Börsen spielen eine zentrale Rolle für die sichere Versorgung mit Metallen und die Durchsetzung lieferkettenübergreifender Standards. Daher sollte die Bundesregierung den Rohstoffhandel bei der Umsetzung des Eckpunktepapiers verstärkt in den Blick nehmen. Durch ein starkes EU-Lieferkettengesetz, das auch den Finanzsektor einschließt, kann Deutschland darüber hinaus indirekt Einfluss auf Rohstoffhändler, Börsen und außerbörsliche Handelsplätze für Metalle ausüben.
