Netzausbau in Deutschland: Rechtlicher Rahmen und Handlungsbedarf

Abstract

Gegenstand der vorliegenden Kurzstudie sind die Auswirkungen des Energiepakets 2011 auf den Netzausbau. Dargestellt werden die rechtlichen Aspekte, die Einfluss auf die Verwirklichung des Netzausbaus insbesondere auf der Höchstspannungsebene haben. Ergänzend eingegangen wird auf die Regelungen zum Netzausbau auf der Hochspannungsebene. Die Änderungen des Energiepakets 2011 gegenüber der bisherigen Rechtslage werden dargestellt und eine erste Einschätzung ihrer Förderungswirkung für den Netzausbau vorgenommen. Im Zentrum der Darstellung stehen die Planungs- und Genehmigungsverfahren für Netzausbauvorhaben einschließlich der Bedarfsplanung. Hierbei wird auch auf die Sonderregelungen für die Erdverkabelung und für die Hochspannungs-Gleichstromübertragung (HGÜ) eingegangen, die zunehmende Bedeutung in der Diskussion gewinnen. Als weitere netzausbaurelevante Regelungen des Energiepakets 2011 werden die Änderungen im Umweltrecht, bei Zahlungen an vom Netzausbau betroffene Kommunen sowie bei der Anerkennung der Netzausbaukosten behandelt.
