Abstract

Im Rahmen der Regulierung des (gewerblichen) Glücksspiels stehen den Behörden eine Reihe von Maßnahmen zur Rechtsdurchsetzung zur Verfügung. Eine Möglichkeit ist die Einziehung rechtswidriger Spieleinrichtungen, die nun mit dem Anfang 2023 eingeführten § 148c GewO auch durch die Gewerbebehörde erfolgen kann. Mit diesem Instrument verfolgt der Gesetzgeber unter anderem das Ziel, dass nicht rechtskonforme Spiele und Spielgeräte mit Gewinnmöglichkeit endgültig aus dem Verkehr gezogen werden. Diese Arbeit befasst sich mit den verfassungsrechtlichen und einfachgesetzlichen Grundlagen sowie den Voraussetzungen der Norm und erläutert die rechtlichen und praktischen Folgen ihrer Anwendung.
