Wirtschaftskriminalität im Schatten der Pandemie - Unternehmen und die Gefahr einer dritten Krise (Fortschreibung)

Abstract

Im Working Paper No. 2/2020 wurde die Entwicklung der Wirtschaftskriminalität im Zuge der Corona-Pandemie analysiert. Auf Grundlage eines Medienlagebildes wurden mit Hilfe kriminalwissenschaftlicher Theorien Auswirkungen der aktuellen Krisenlage für das Deliktfeld der Wirtschaftskriminalität bewertet sowie Handlungsempfehlungen für Unternehmen erörtert. Hierbei wurde neben der durch die Pandemie hervorgerufenen gesundheitlichen Krise (1. Krise) und der mittelbar durch die ergriffenen Gegenmaßnahmen entstehenden ökonomischen Krise (2. Krise) auf die Gefahr einer weiteren, dritten Krise, hingewiesen, die durch kriminelles Handeln hervorgerufen wird, welches sich die veränderten Rahmenbedingungen zunutze macht. In dieser Fortschreibung wird der Blick auf die Entwicklungen der strafrechtlich relevanten Delikte der Wirtschaftskriminalität mit Bezug zur Covid19-Pandemie sowie auf die Entwicklung der Insolvenzdelikte gelegt.
