Von der Rundfunkgebühr zur Haushaltsabgabe

Abstract

Die deutsche Rundfunklandschaft, also das Fernsehen und der Hörfunk, beruht auf einem Nebeneinander von öffentlich-rechtlichen und kommerziellen Anbietern. Während sich der private Rundfunk ausschließlich über Werbung finanziert, deckt der öffentlich-rechtliche Rundfunk seine Ausgaben vorwiegend über Gebühreneinnahmen ab. Rechtliche Grundlage für die Erhebung von Gebühren ist der Rundfunkgebührenstaatsvertrag (bzw. aktuell der Rundfunkbeitragsstaatsvertrag). Streng genommen sind die Gebühren eigentlich Beiträge, da die Zahlungspflicht nicht aus der tatsächlichen, sondern aus der möglichen Inanspruchnahme von öffentlich-rechtlichen Rundfunkleistungen resultiert.
