Nichttarifäre Handelshemmnisse durch Prämien, Subventionen und Ausgleichszölle

Abstract

Nach Artikel VI Abs. 3 GATT kann ein Sonderzoll als Ausgleichszoll erhoben werden, um jede mittelbar oder unmittelbar für die Herstellung, Gewinnung oder Ausfuhr einer Ware gewährte Prämie oder Subvention unwirksam zu machen. Den Ausgleichszöllen wird bisher weder im nationalen Recht und in der nationalen Praxis noch in den Regelungen im internationalen Bereich die gleiche Bedeutung beigemessen wie den Maßnahmen gegen das Dumping. Dies mag zum einen daran liegen, daß in der Vergangenheit Dumpingfälle häufiger und für den Handel störender waren, wohl aber auch daran, daß die Chance, die Unterstützung der eigenen Regierung dafür zu gewinnen, den wettbewerbsverzerrenden Praktiken von einzelnen Unternehmen oder Branchen beizukommen, größer war als dafür, die Maßnahmen eines anderen Staates zu bekämpfen und sie durch staatliche Gegenmaßnahmen der eigenen Regierung ausgeglichen zu erhalten.
