Entgelte und Entgeltordnungen in Werkstätten für Menschen mit Behinderung: Reformbedarfe und Handlungsempfehlungen

Abstract

Auf den Punkt: In Interviews mit Expert*innen u.a. aus Wissenschaft, Verwaltung, Arbeitsrecht und Gewerkschaft wurden Grundsätze der Entgeltbemessung in Werkstätten für Menschen mit Behinderung (WfbM) diskutiert. Die gesetzliche Grundlage zur Entgeltbemessung in WfbM basiert auf einem reformierungswürdigen Paragrafen, der für einen individualisierten Entgeltbestandteil insbesondere Arbeitsmenge und Arbeitsgüte als Bemessungskriterien vorsieht. Im Sinne des Auftrages der WfbM sind nach Ansicht der Autor*innen anforderungs- und qualifikationsgerechte Entgeltkriterien geeignet; markt- und verhaltensbezogene Kriterien sind zu vermeiden. Darüber hinaus ist die gesetzeskonforme Mitbestimmung der Werkstatträt*innen an Konzeption, Anwendung und Evaluation der Entgeltordnungen sicherzustellen.
