Abstract

Auf den Punkt: Tarifabweichungen sind betriebsbezogene Unterschreitungen der Flächentarifvertragsnormen, die durch die Tarifvertragsparteien legitimiert werden. In der Chemischen Industrie und der Metallindustrie finden sie in etwa jedem zehnten tarifgebundenen Betrieb Anwendung. Tarifabweichungen werden von den Gewerkschaften inzwischen prozedural und inhaltlich stärker kontrolliert. Betriebsräte agieren bei betrieblichen Tarifunterschreitungen als Tarifakteure im Betrieb. Im Zuge der Tarifabweichung gewinnen die Betriebsräte mit Unterstützung der Gewerkschaften häufig an Statur gegenüber den Unternehmensleitungen. Konflikt- und beteiligungsorientierte Verhandlungsstrategien stärken die Legitimation der Interessenvertretungen und die Organisationsmacht der Gewerkschaft im Betrieb. Beteiligungsorientierte Strategien werden von der Gewerkschaft getragen.
