Mitbestimmung mit EU-Recht vereinbar: Juristische Kommentierungen zu den Schlussanträgen des Generalanwalts im Verfahren Erzberger/TUI

Abstract

Am 4. Mai 2017 hat der Generalanwalt am Gerichtshof der Europäischen Union Saugmandsgaard Øe seine mit Spannung erwarteten Schlussanträge in der Rechtssache C-566/15 (Erzberger), auch als sog. TUI-Verfahren bekannt, vorgelegt. Die renommierten Rechtswissenschaftler Prof. Dr. Rüdiger Krause aus Göttingen und Prof. Dr. Bernard Johann Mulder aus Oslo nehmen zu den Anträgen Stellung. So zeigt Prof. Krause auf, dass der Generalanwalt mit seinen klaren und nüchternen Ausführungen die Debatte über einen vermeintlichen Verstoß des deutschen Mitbestimmungsrechts gegen europäisches Recht weiter in ein deutlich ruhigeres Fahrwasser gelenkt hat.
